Plaintiff Jeffrey Lewis Moore, a Sergeant with the Los Angeles County Sheriff's Department, filed suit against his employer the County of Los Angeles claiming he was owed back pay.

PLAINTIFF'S CONTENTIONS:
Plaintiff contended he was suspended without pay under Los Angeles County Civil Service Rule 18.01 because he was charged with felony domestic violence. Plaintiff was returned to work after his criminal case was dismissed.
Plaintiff claimed that he was entitled to back pay under his applicable Memorandum of Understanding.
DEFENDANT'S CONTENTIONS:
The county claimed that plaintiff was not entitled to back pay because he did not meet the requirements set forth in the Los Angeles County Code. Specifically, plaintiff failed to appeal his unpaid suspension to the Los Angeles County Civil Service Commission, thereby waiving any recovery of back pay.
