Facts

Bridgette Aguilar, Guardian ad litem for Kainoa Robb filed a complaint against Carolyn Colvin, Acting Commissioner of Social Security, challenging the denial of Robb's application for supplemental security income.

Contentions

PLAINTIFF'S CONTENTIONS:
Robb claimed to be disabled beginning in December 2005 due to mental impairments. Robb claimed that despite having undergone several treatment programs, he continued to suffer from mental impairments, including having suicidal thoughts, irritability, and bouts of insomnia. In addition, Robb acknowledged his illicit drug use. He applied for SSI benefits because of his disability, but was denied. Robb contended that the denial was erroneous.

DEFENDANT'S CONTENTIONS:
The Commissioner contended that Robb was ineligible for the SSI benefits he requested because he was able to work despite his substance abuse disorders and provided he follow through with treatment.

Result

The court upheld the denial of SSI benefits.
