Glen Sassoon filed a complaint against Lowe's HIW Inc. in connection with an incident that occurred on Aug. 13, 2012 at one of defendant's store.
Contentions
PLAINTIFF'S CONTENTIONS:
Sassoon contended she was following a sales clerk along a small center aisle where someone had left a store ladder, and tripped on the edge of the ladder. Sassoon claimed she was injured and sued Lowe's for premises liability. Sassoon alleged causes of action for negligence, willful failure to warn, and dangerous condition on public property.
DEFENDANT'S CONTENTIONS:
Lowe's denied Sassoon's allegations, and asserted that any alleged injury she suffered was the result of her own negligence. Lowe's asserted various other affirmative defenses.
Result
The court dismissed Sassoon's complaint with prejudice, and entered judgment in favor of Lowe's accordingly.
