Facts

H & C Global Supplies SA DE CV sued Pandol Associates Marketing Inc.

Pandol is a California Company that engages in the purchase and sale of perishable agricultural commodities. Pandol and H&C entered into contracts, where H&C agreed to deliver produce on a consignment basis and Pandol would re-sell those products.

Contentions

PLAINTIFF'S CONTENTIONS:
Around Jan. 25, 2013, H&C delivered produce to Pandol, and Pandol received those shipments. Pandol went on to re-sell them, but did not pay H&C.

Result

The court ruled in H&C's favor, granting its motion for judgment on the pleadings and on its Perishable Agricultural Commodities Act and breach of contract claims.
