On Jan. 26, 2011, plaintiff Richard Perea was traveling westbound on Ramon Rd. when he was involved in a collision with defendant John Joseph Sherry.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended he stopped while driving, due to heavy traffic. Then defendant, who was speeding, hit the car in front of him which in turn rear-ended plaintiff's vehicle.
DEFENDANT'S CONTENTIONS:
Defendant contended that plaintiff had pre-existing medical issues and that the injuries sustained from the accident should have been resolved in six to eight weeks.
Injuries
Plaintiff suffered cervical spine traumatic rupture at C5-6, disc desiccation with abutment of exiting nerve roots bilaterally, and left upper extremity radiculopathy.
Result
The case settled for $100,000.
