Hali Hudson filed a lawsuit against Jutta Schamp in relation to a motor vehicle accident.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on Feb. 2, 2011, she was on a Vespa scooter and drove into an intersection, where a vehicle driven by defendant smashed into her as defendant turned left. Plaintiff claimed defendant drove negligently and should have allowed other traffic, instead of making a dangerous turn.
DEFENDANT'S CONTENTIONS:
Defendant argued against damages and injuries.
Damages
Plaintiff sought $1,250 in past lost earnings, $32,937 in past medical costs and between $245,000 and $375,000 in future medical costs.
Injuries
Hudson claimed she suffered ankle, back, neck, head and shoulder injures. She claimed to have sustained a bulging cervical disc, bulging lumbar disc, headaches, myofasciitis, cervical sprain, talofibular ligament tear, tendonitis, vision impatient and whiplash. She received chiropractic care, epidural injections, and physical therapy.
Result
Under a settlement agreement, defendant agreed to pay $55,000.
