Mariano Vera sued Dr. Garo Tertzakian and La Veta Surgical Center, involving allegations of medical malpractice.
Contentions
PLAINTIFF'S CONTENTIONS:
On Sept. 9, 2013, plaintiff allegedly underwent cryoablation to treat prostate cancer at La Veta that was performed by Dr. Tertzakian. Plaintiff allegedly suffered from a severe infection caused by defendants' negligence, which ultimately resulted in the loss of his right testicle. As such, plaintiff sued defendants for medical malpractice.
DEFENDANTS' CONTENTIONS:
Defendants denied the allegations and asserted various affirmative defenses. Defendants separately moved for summary judgment.
Result
The court granted La Veta's motion for summary judgment. No opposition was filed as to defendant La Veta Surgical Center pursuant to stipulation and agreement. An opposition was filed as against Garo Terzakian, M.D. Following receipt of the opposition, defendant Terzakian voluntarily dismissed his motion for summary judgment.
