Adrian Morgan sued the County of Los Angeles and others related to treatment he received while in the Los Angeles Sheriff's Dept. custody.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff was arrested on Feb. 26, 2006, and underwent surgery to treat a gunshot wound on his left leg. In May 2006, after being transferred to LASD custody, and while on crutches, plaintiff fell when his crutch went into an uncovered drain in the shower and the his left femur broke again and the hardware placed in his leg after the gunshot broke and was dislodged. Plaintiff spent two years in LASD custody and received no medical treatment. When plaintiff was transferred to State Prison in May of 2008, he was wheelchair bound for life. Plaintiff filed suit while still in State Prison.

Initially the case was dismissed with prejudice by the district court for failure to exhaust administrative remedies. Plaintiff appealed the dismissal and the Court of Appeal reversed and remanded.

DEFENDANTS' CONTENTIONS:
Defendants moved to dismiss the complaint for failure to exhaust administrative remedies and failure to state a claim for relief.

Result

The parties reached a $175,000 settlement.
