Plaintiff Tatiana Zanjani, 25, sued defendants Berenice Valencia and Maria Ortega following an automobile collision that occurred on Aug. 29, 2012 near Diablo Valley College and Sun Valley Mall, in Pleasant Hill.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that she was waiting to make a left hand turn but that her vehicle was stopped because the heavy traffic in front of her prevented her from doing so. She claimed that Valencia honked at her and attempted to drive the vehicle she was operating around plaintiff's, but then swerved back into the left lane after seeing approaching traffic, causing Valencia to rear-end plaintiff's vehicle. Plaintiff argued that Valencia was liable and that Ortega, the owner of the vehicle Valencia was driving, was vicariously liable.
DEFENDANT'S CONTENTIONS:
Valencia admitted liability but contested the extent of plaintiff's injuries.
Injuries
Plaintiff claimed injuries to her shoulder, neck and midback, with radiating pain into her hands and legs. She underwent chiropractic treatment and physical therapy.
Result
The jury awarded plaintiff $4,021 in damages.
