Mona Elias sued Melissa Evans and HV Anaheim Homeowners Association Inc., in connection with a dog-bite incident that allegedly occurred on Aug. 6, 2014.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff was allegedly walking her dog at the Heritage Village condominium complex when defendant Evans' three dogs attacked her. Plaintiff was injured as a result and sued the dog owner, Evans, for strict liability and negligence. Plaintiff also asserted a negligence cause of action against defendant homeowners' association for negligence.
DEFENDANTS' CONTENTIONS:
Defendant HV denied the allegations and asserted various affirmative defenses. Defendant Evans likewise denied the allegations and asserted various affirmative defenses.
Defendant HV filed a cross-complaint against co-defendant Evans for implied indemnity, contribution, and declaratory relief. HV claimed Evans was solely liable for plaintiff's alleged injuries.
Result
Elias and HV ultimately agreed to settle their dispute for $10,570.
