PLAINTIFF'S CONTENTIONS:
Plaintiff was riding his motorcycle along Garnet Ave. in San Diego when he was struck by defendant, who was turning left. Plaintiff sustained injuries as a result and sued defendant for negligence. Plaintiff claimed defendant failed to keep a proper look out and did not signal prior to making his turn.
DEFENDANT'S CONTENTIONS:
Defendant contended that plaintiff attempted to pass him as he was making a left turn on the left-turn lane. Defendant claimed plaintiff was to blame for his own injuries.
Settlement Discussions
Rodriguez made a CCP 998 demand of $75,000; Perez made a CCP 998 offer of $15,000.
Damages
Rodriguez sought $700,000 in damages, including $17,915 in medical expenses.
Injuries
Rodriguez suffered a spinal injury. His doctor recommended discectomy and fusion.
