On July 25, 2013 Luis Juarez, 42, was fatally shot by a Los Angeles County Sheriff's Deputy while in the City of Compton. His wife and minor children sued defendants.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that a Sheriff's Deputy shot Juarez three times during a traffic stop even though Juarez was unarmed and posed no immediate or significant threat to anyone.
Plaintiffs asserted causes of action for assault, battery, negligence, excessive force (42 U.S.C. Section 1983), excessive force (42 U.S.C. Section 1983 Monell), failure to properly screen and hire, failure to train, supervise and discipline, violation of California Civil Code Section 52.1, false arrest, and false imprisonment.
DEFENDANT'S CONTENTIONS:
Defendants denied plaintiffs' allegations and asserted various affirmative defenses.
Result
Plaintiffs settled with Los Angeles County for $500,000.
