Facts

John Verant and Deborah Verant sued David Gotham, D.O., Rebecca Gotham, R.N., David R. Gotham Jr., D.O., Inc., and Sutter Health Sacramento Sierra Region d/b/a Sutter Roseville Medical Center, involving allegations of medical malpractice.

The matter proceeded against Dr. Gotham only after Nurse Gotham, the Medical Center, and Dr. Gotham's medical office were dismissed.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiff John Verant underwent a surgical procedure to revise his total hip prosthesis that was performed by orthopedic surgeon, Dr. Gotham. Despite the revision surgery, he continued to experience pain and discomfort. He ultimately had to undergo another hip revision surgery and subsequently sued defendants for medical negligence. Defendants allegedly failed to properly perform the initial revision surgery, necessitating a second revision surgery. Defendant doctor allegedly placed the screws improperly resulting in protrusion and bone-on-bone impingement. Plaintiff also alleged the acetabular cup was placed too medially and superiorly to be substandard and failure to inform patient of the various deficiencies in the subject revision.

Settlement Discussions

John Verant demanded $250,000 in settlement.

Damages

Plaintiff sought $100,000 in lost wages plus pain and suffering damages.

Injuries

Plaintiff continued to suffer from hip pain following Dr. Gotham's surgery, necessitating a second revision surgery 18 months later that was performed by another doctor. Though his condition has improved, he nevertheless continued to experience ongoing pain and discomfort.

Result

The jury found in favor of Dr. Gotham.
