The Mayo Foundation for Medical Education and Research filed an infringement claim against Mark Taheri D.D.S. and Mark Taheri D.D.S. Inc.
Contentions
PLAINTIFF'S CONTENTIONS:
The Mayo Foundation owned the rights to the trademarks "Mayo" and "Mayo Clinic." Defendants allegedly infringed on Mayo's trademark rights by advertising dental services under the business name and trademark "Mayo Dental" without authorization. Defendants allegedly used counterfeit and other colorable copies of Mayo's trademarks in ways that were likely to cause confusion.
The Mayo Foundation filed this action for federal trademark infringement, unfair competition, and federal trademark dilution.
DEFENDANTS' CONTENTIONS:
Defendants denied the allegations and asserted various affirmative defenses.
Result
The parties entered into a consent decree and permanent injunction enjoining defendants from using the term Mayo.
