Plaintiff Ruby Beato was employed for 12 years as a housekeeper at Jacob Health Care Center. She was discharged.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff filed a complaint containing eight causes of action for discrimination, harassment, violation of the California Family Rights Act, defamation, retaliation, breach of contract, interference with prospective economic advantage, and violation of Labor Code section 1050.

DEFENDANT'S CONTENTIONS:
Defendants contended that plaintiff's claims were without merit and that plaintiff was discharged for a legitimate, nondiscriminatory reason, namely, her attempted sale of Avon products to a resident.

Settlement Discussions

A mediation conducted by the National Conflict Resolution Center was unsuccessful. Follow-up negotiations also were unsuccessful.

Damages

Plaintiff sought lost wages, emotional distress damages, punitive damages and attorney's fees.

Result

Summary judgment was entered in favor of defendants.

Other Information

Plaintiff may appeal.
