Facts

Jerome Netterville, a 36-year-old father of four minor children, was killed when his vehicle struck an overturned big rig. The big rig, traveling under the freeway speed limit, lost control when an unidentified vehicle cut it off on a dark stormy night. In an attempt to evade the vehicle, the truck changed lanes, in so doing, the load shifted, the driver lost control, and the big rig turned onto its side blocking 2 1/2 lanes of a four-lane freeway. The decedent was not wearing his seat belt and suffered fatal head injuries when his vehicle struck the overturned big rig. Two other vehicles also struck the overturned big rig.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs claimed that the driver was negligent in failing to maintain control of his tractor trailer.

Result

The case settled for $950,000.
