Plaintiff Charles Dunn Company Inc. (CDC) sought damages from defendant Singpoli Pacifica Development Ltd. (Singpoli) claiming breach of contract.

Contentions

PLAINTIFF'S CONTENTIONS:
CDC contended that Singpoli entered into written agreement to use CDC's brokerage services exclusively for a one-year period toward the purchase of certain real property and to pay CDC a commission of 6 percent of the purchase price upon closing. Within the exclusivity period, and without CDC's knowledge, Singpoli hired a different broker and closed escrow on the purchase of the subject property through that broker.

DEFENDANT'S CONTENTIONS:
Singpoli claimed that it did not enter into a one-year exclusive representation contract with CDC.

Result

The jury found for the CDC and awarded $186,000. The total judgment was $290,042.
