Facts

In August 2003, plaintiff Bhupat Bhatti was interviewed by defendant, County of Sacramento social worker Seleena Ulahannan. Bhatti's wife stated she was afraid to leave the house and was without friends in the United States. After the interview, the defendant offered social services to the family, and told Bhatti's wife about a shelter for women who were victims of domestic violence. Bhatti's wife requested placement in the shelter for her and her child. The defendant brought them to the shelter.

The plaintiff sued the County of Sacramento (which was dismissed on summary judgment), and defendant for wrongful removal of his child from his care and custody.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff claimed that the defendant should not have removed the child from plaintiff's custody and that defendant had conspired to remove the child.

DEFENDANT'S CONTENTIONS:
The defendant contended that she did not interfere with plaintiff's rights regarding his child. Bhatti's wife had equal rights to make decisions for the child. Since the child was removed in the mother's care and custody, the defendant had nothing to do with the actual removal of the child from plaintiff's custody. The defendant only provided transportation to the shelter, which was allowed under California law.

Damages

The plaintiff claimed $4 million for emotional distress. The plaintiff sought $1 million in punitive damages.

The plaintiff claimed emotional distress.

Result

The jury returned a verdict for defendant.
