Facts
On Feb. 7, 2008, plaintiff Gregory Shelton was heading westbound on Palms Boulevard in his Chevrolet pickup truck when he came to a complete stop at the four way intersection in Inglewood Boulevard in Mar Vista. Shelton waited for the right of way and as he proceeded to make a left turn onto Inglewood Boulevard, his vehicle was struck above the rear wheel by a compact vehicle driven by defendant Bing Han.
Shelton sued Han, alleging motor vehicle negligence and negligence per se.
Han denied liability and claimed that Shelton's treatment was excessive. Han contended that he had the right of way and that Shelton did not utilize his left turn signal and that Shelton was responsible for the accident.
Settlement Discussions
The plaintiff made a C.C.P. Section 998 demand of $15,000. The defendant made no offer.
Injuries
Shelton suffered soft tissue injuries to his back and neck. Five days after the accident, he sought treatment for the first time. Over the course of the next eight months, he underwent 34 physical therapy treatments and 46 chiropractic treatments. The defense counsel argued that the accident was low impact and did not cause Shelton's injuries.
Result
Plaintiff's verdict for $30,733.
