Plaintiff Kathy McFall was employed by City of Tracy as its human resources manager. McFall was disciplined and eventually terminated for a variety of work performance issues. She alleged wrongful termination, harassment and discrimination.

The claims that were tried included alleged unlawful retaliation under the Fair Employment and Housing Act (FEHA), and Labor Code Section 1102.5. In addition, the plaintiff claimed unlawful harassment under the FEHA.
