On Jan. 8, 2006, plaintiff Dale Butler and defendant Travis Daniels were involved in a three-vehicle traffic accident on I-605 at Florence Avenue in Downey. Plaintiff Saundra Butler, Dave Butler's wife, was a passenger in the car when the accident occurred. Saundra Butler became successor-in-interest to the suit when Dave Butler passed away during litigation. Dave Butler's death was unrelated to the proceedings.
Contentions
PLAINTIFFS' CONTENTIONS:
The Butlers claimed that Daniels was at fault for the accident when he illegally and dangerously changed lanes.
Settlement Discussions
The Butlers demanded $6,000, each, prior to trial, which was down form the initial demand of $12,000, each. Daniels offered $500.00 to settle with Saundra Butler as successor in interest for Dale Butler and $1,000 to settle with Saundra Butler. Both offers were in the form of Offers to Compromise, which expired. Those offers were re-offered prior to trial.
Damages
Dale Bulter claimed $4,260 in medical expenses and $17,872 in lost wages. Saundra Butler claimed medical expenses of $4,305. She did not claim any lost income.
Injuries
Dale Bulter claimed headache and back pain. Saundra Butler sustained headache, hip, neck, and shoulder pain.
Result
The verdict was issued for Daniels and $8,465 was awarded in costs.
