Facts

Defendant Boy Scouts of America operated a zip-line at the Scout-O-Rama located at Kelly Park in San Jose. Plaintiff Linden Feldman jumped and fell 25 feet, sustaining severe injuries, due to a failure to properly secure him.

Injuries

Plaintiff's wife, Sandy Feldman, alleged damages for loss of consortium. Bret and Tara Feldman, the couple's minor children, alleged severe emotional distress from witnessing the event.

Result

The Boy Scouts settled for $3,650,000. The harness manufacturer settled for $125,000 at the 1st mediation. Evidence disclosed no defect in the harness, but rather that the attachment "clip" was not placed on the attachment "loop" by the zip-line operator.
