Facts

Plaintiffs challenged the U.S. Dept. of Agriculture's decision to end a nationwide ban of Roundup Ready alfalfa, a genetically engineered herbicide-resistant strain of alfalfa manufactured by Monsanto Co. Plaintiff farmers were concerned that the product would be spread by wind and bees, pollinating their crops and taking over their fields.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs argued that the Dept. of Agriculture had failed to take into account the effects of increased herbicide use that would follow from the approval of herbicide-resistant alfalfa.

Result

The court ruled in the Dept. of Agriculture's favor, finding that federal law does not require the Dept. to account for the effects of cross-pollination on commercial crops.
