Facts
Julian Santos was driving through an intersection when he was broad-sided by Constance Patricia Greene, who had been making a left turn. He sued for negligent operation of a vehicle. Santos contended that Greene was negligent for attempting to make a left turn at an uncontrolled intersection and failing to yield to oncoming traffic. Greene admitted liability.
Damages
Santos sought $61,816 for past medical costs, $98,000 for past lost earnings, and $150,000 for pain and suffering.
Injuries
Santos was taken from the scene of the accident by an ambulance and treated for pain to his right shoulder and knee. He later underwent reconstructive surgery on his right knee and several weeks of physical therapy. He was unable to work during his treatment and when he returned to his job he was fired. He claims to still experience residual pain.
Result
The parties settled for $155,000.
