Facts

Ubisoft Entertainment S.A. manufactured "Just Dance," a series of dance-based video games. OG International manufactured "Get Up and Dance," a competing dance-based video game. OG filed a complaint seeking declaratory relief, which Ubisoft answered with a request for temporary restraining order (TRO) and preliminary injunction enjoining the release of OG's dance game. Ubisoft claimed copyright and trade dress infringement.

Result

The court denied Ubisoft's request for TRO and preliminary injunction.

Other Information

On Feb. 23, 2012, the Ninth Circuit summarily affirmed the District Court's denial of the motion for TRO and preliminary injunction.
