Plaintiff Catrina Sheldon was a passenger in a vehicle driven by defendant April Keyes. The vehicle was involved in an accident, and Sheldon sued April Keyes and her mother Bailey Keyes, who owned the vehicle April was driving.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that while she was in the vehicle, April drove on a dirt mountain road in Kern County. She claimed that April tried to move into another lane, but drove over the road's side, which resulted in a rollover of the vehicle. Plaintiff claimed that the car came to a stop with the driver's side facing the ground. Plaintiff claimed that April drove negligently because she was driving too fast, and that her mother had to be held responsible as well.

DEFENDANT'S CONTENTIONS:
Defendants argued that the $765 in treatment that plaintiff received from Kaiser, the only treatment plaintiff received in the first 8 months following the incident, was all the care plaintiff needed for the accident.

Damages

She sought $1,400 in lost earnings.

Injuries

Sheldon suffered aggravation of a preexisting condition of her right knee, and post-traumatic stress disorder. She underwent arthroscopy.

Result

The jury's verdict awarded Sheldon $4,900, which included $3,800 in past medical costs and $1,100 in past lost earnings, but nothing for the arthroscopy.

Other Information

Plaintiff's motion for new trial was denied.
