Facts
Joanna Puentes was driving her vehicle when she was involved in an accident with a vehicle driven by Alicia Bogard. Puentes sued Bogard.
Contentions
PLAINTIFF'S CONTENTIONS:
Puentes alleged that on May 18, 2009, she was driving in an apartment complex parking lot, when defendant reversed out of a parking space and hit plaintiff's car. Plaintiff argued that defendant reversed in an unsafe manner because plaintiff drove on the right side of the lot, 10 feet from defendant's car.
DEFENDANT'S CONTENTIONS:
Defendant argued that she only reversed three or four feet back when the accident occurred, and that plaintiff was driving on the incorrect side of the lot. Also, defendant argued that there was a lack of good visibility in the lot.
Settlement Discussions
Plaintiff demanded $910,000 and the defense offered $36,000.
Injuries
Plaintiff suffered herniated discs at L3-4, L4-5, and L5-S1, and received chiropractic treatment.
Result
The jury found in favor of Bogard, determining that she did not do anything negligent.
