Contentions
PLAINTIFF'S CONTENTIONS:
Defendant allegedly infringed plaintiff's rights to U.S. Patent Nos. 7,346,472; 7,660,700; 7,949,494; 8,214,175; and 8,712,728. The patents were allegedly related to the managing, monitoring, and monetization of informational assets and digital content.
Result
The parties agreed to stay this case pending the resolution of Blue Spike's appeal over its lawsuit against Google. In the Blue Spike v. Google case, Blue Spike sued Google for patent infringement. The district court, however, found in favor of Google, finding the asserted patent claims invalid for lack of patentable subject matter. The parties in this case agreed that if the Federal Circuit Court of Appeals affirms the judgment of invalidity, then Blue Spike expressly agrees to drop this instant case on grounds of collateral estoppel. Following affirmance of the underlying Google action, the district court dismissed this instant action with prejudice pursuant to the parties' stipulation.
Other Information
On Nov. 14, 2016, in its related Google appeal, Blue Spike filed a combined petition for panel, rehearing and rehearing en banc.
