Facts

Plaintiff was an inmate at the Twin Towers Correctional Facility, in Los Angeles. He brought a federal civil rights action pursuant to 42 U.S.C. section 1983 against Deputy Jose Martinez, in both his individual and official capacity.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant violated his civil rights by making false statements in a police report, falsely testifying at a preliminary hearing, and for moving evidence.

DEFENDANT'S CONTENTIONS:
Defendant contended that the action should be dismissed because plaintiff failed to make any factual allegations to support the conclusion that defendant violated his civil rights, and because the allegations were indefinite and ambiguous.

Result

The court dismissed the action without prejudice for failure to prosecute.
