Facts

On June 23, 2012, plaintiff, 40s, was the passenger in a vehicle that was involved in a collision with a vehicle driven by defendant. The collision occurred at an intersection on San Vicente Blvd. in Los Angeles.

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant negligently operated his vehicle when he sideswiped plaintiff's vehicle, which was stopped at a driveway waiting to exit. She asserted a motor vehicle cause of action against defendant.

DEFENDANT'S CONTENTIONS:
Defendant did not dispute liability, but contested plaintiff's injuries, arguing that a prior car collision plaintiff was involved in was responsible for her injuries.

Settlement Discussions

Plaintiff made a demand for $500,000 during trial and the defense made a CCP section 998 offer of $350,000. Plaintiff made a 998 demand of $750,000.

Injuries

Plaintiff claimed injury to her C5-C6 disc, for which she underwent a cervical discectomy and fusion.

Result

The jury returned a verdict for plaintiff, awarding her $105,000.
