Dana Blackwood sued Soon Kong, Grace Kong, and Kwang Kong, in connection with a motor vehicle collision that allegedly occurred on Aug. 15, 2013. Grace and Kwang Kong were ultimately let out of the case and the matter continued against Soon Kong only.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff was driving along the I-5 freeway in Santa Ana when she was rear-ended by a vehicle operated by defendant. Plaintiff was injured and sued defendant for negligence.
DEFENDANT'S CONTENTIONS:
Defendant contended that the collision occurred during stop-and-go traffic.
Settlement Discussions
Blackwood demanded $45,000, which Kong countered with a $30,000 offer of settlement.
Injuries
Blackwood injured her neck and left shoulder. An MRI revealed deterioration in her spine. Blackwood claimed that the collision aggravated her pre-existing arthritis. She underwent physical therapy as well as chiropractic and acupuncture care. Blackwood continued to experience limitations in her neck and head and may need future injections and surgical fusion.
Result
The parties reached a $45,000 settlement.
