PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that defendants charged customers exorbitant late fees without notice. Plaintiffs asserted causes of action for negligence, unfair business practices, violation of the Consumer Legal Remedies Act, breach of the implied covenant of good faith and fair dealing, money had and received, unjust enrichment, and violation of Civil Code section 1671.
DEFENDANTS' CONTENTIONS:
Defendants denied it violated any laws.
Result
Pursuant to the settlement reached between the parties, eligible class members will receive $25 or credit for one late fee. The class is estimated at 170,824 consumers.
