Facts

On Nov. 4, 2014, plaintiff Jennifer Vargas, 42, was walking her dog in a grassy area located next to a parking lot when she was struck by a vehicle that was reversing out of parking spot. She sued the driver of the vehicle and the vehicle's owner for negligence.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that the driver negligently operated her vehicle and that the owner of the vehicle was vicariously liable.

DEFENDANT'S CONTENTIONS:
The driver denied that she struck plaintiff, claiming the incident did not occur.

Injuries

Plaintiff claimed she sustained whiplash to her neck and three chipped teeth.

Result

The jury found the driver negligent and awarded plaintiff $53,285 in damages.
