Facts
On June 3, 1995, the patient, Benito Escobar visited South Auburn General Clinic. The patient was diagnosed
with probable pancreatitis, secondary to a history of significant ingestion of alcohol. He was advised to go to
hospital, but the patient declined. The patient was treated and released.
The plaintiff claimed that later that evening, the patient presented to South Auburn General emergency room
where he was evaluated and admitted with the same diagnosis. The patient died two days later from
physiological complications of pancreatitis.
