Facts

In October 2001, plaintiff B. Jeanne Zincke, a children's caretaker in her 60s, entered the intersection of Eureka Road and Douglas Boulevard in Roseville in her Infiniti. Defendant Craig Anderson ran a red light and crashed into plaintiff, injuring her neck and back. The plaintiff sued the defendant for negligence, claiming he was not paying attention. The defendant conceded liability, but contested the extent of plaintiff's injuries.

Settlement Discussions

The plaintiff made a demand of $10,000; defendant's offer was $4,000.

Injuries

The plaintiff claimed she suffered neck and back pain, and tingling and numbness to her lower extremities and left thumb. She also claimed to suffer post-traumatic stress disorder (PTSD). She sought $25,000, including medical bills of $4,600 and non-economic damages. The defendant argued that plaintiff suffered from degenerative disc disease and osteoarthritis before the accident. It also argued the plaintiff did not suffer from PTSD.

Result

The jury awarded plaintiff $3,400 ($1,400 economic damages and $2,000 noneconomic damages). Defense counsel asserted that the jury rejected plaintiff's PTSD claim.
