On Dec. 29, 2006, plaintiff Phoenix Life Insurance Company and defendant Jennifer Chan entered into a loan agreement for $471,298. Chan executed a promissory note and agreed to monthly payments of $40,131.

The plaintiff contended that defendant defaulted in the loan in May 2007, when she failed to pay the full monthly amount due.

DEFENDANT'S CONTENTIONS:
The defendant contended the plaintiff owed her $294,679.

Damages

Plaintiff claimed $294,679 and interest, plus attorney fees as well as costs.

Result

The parties settled for $218,134 via stipulated judgment. Pre-judgment interest was awarded for $51,483 and attorney fees for $30,383.
