Facts

Hilda Solis, Secretary of Labor filed an action against the Industrial Professional and Technical Workers Union (IPTWU) pursuant to Title IV of the Labor Management Reporting and Disclosure Act (Act), seeking a judgment ordering IPTWU to conduct an election for officer positions under plaintiff's supervision.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that defendant's failure to conduct an election of union officers constituted a violation of the Act, which required local unions to perform an election of officers once every three years.

Result

The parties reached a settlement whereby defendant agreed to conduct nominations and an election for officer positions by secret ballot by Sept. 30, 2011. Further, it was agreed that the supervised election shall be conducted in accordance wit the Act.
