Plaintiff/cross-defendant Laurel Center Group filed two consolidated civil lawsuits where it alleged breach of contract, account stated, and open book account claims against defendant/cross-complainant DSW Inc. related to a lease agreement. Laurel Center also sought a declaratory judgment that DSW Inc. wrongfully terminated the lease agreement for the store previously located in Laurel Center Group's shopping center.
DSW Inc. denied all of Laurel Center's claims, and brought a consolidated cross-complaint alleging that Laurel Center breached the parties' contract. DSW Inc. alleged that Laurel Center intentionally misrepresented material facts in an estoppel certificate that DSW Inc. relied upon and which induced it to assume the lease agreement.
Laurel Center denied all of the cross-claims.
Result
Verdict for DSW Inc. for $189,580.
