Facts
Dennis Keith Kennedy was driving a pickup truck. While stopped at a red light, a sports utility vehicle operated by Angela Melodee Jellison struck him from behind. Kennedy sued Jellison for negligent operation of her vehicle. He claimed that Jellison had driven inattentively and struck his vehicle from behind. Jellison claimed she had made a full stop but her foot had accidentally come off the brake pedal, causing her vehicle to lightly come into contact with Kennedy's. She admitted liability, acknowledging that their vehicles did make contact.
Damages
Kennedy sought recovery of damages for medical costs, lost earnings, and pain and suffering.
Injuries
Kennedy claimed soft tissue injuries to his neck, right shoulder, left hip, left leg, and ribs. He underwent physical therapy to treat the injuries but still claimed residual pain. He claimed to now suffer from blurred vision, headaches, and ringing in his ears.
Result
The jury ruled for the defense.
