Facts

On Nov. 25, 2001, Esquivel Grading & Paving Inc., which was a contractor for the City and County of San Francisco, was performing work on a city street when a water main started to leak. After a City crew arrived at the scene, the main ruptured, creating a geyser of water that damaged abutting property owned by DeWolf Realty Company Inc.

DeWolf and its insurer, Chubb Custom Insurance Company, filed suit against the City and Esquivel, seeking damages for the injury to the property.

Result

The parties settled by payments from the City and Esquivel. The City contributed $91,000, and Esquivel contributed a confidential amount.
