Facts
The U.S. Government alleged failure to conduct inventory controls over prescription painkillers, including Vicodin and OxyContin, and failure to account for significant amounts of the prescription painkiller against three owners of San Diego pharmacies. The three pharmacies were: Galloway Pharmacy, Park Boulevard Pharmacy, and White Cross Pharmacy.
Contentions
PLAINTIFF'S CONTENTIONS:
The government contended that defendants' failure to account for the prescription painkillers provided the opportunity for their employees to engage in a widescale practice of ordering and illegally selling, or diverting, large amounts of the drugs in the black market.
Result
A $1.25 million settlement was reached. Also as part of the settlement, the owners agreed to surrender their controlled substances registrations and sold their interests in the three pharmacies.
