Facts
Jose Guantes was attempting to make left turn when he was involved in a collision with another vehicle operated by Arthur Rodriguez. Guantes suffered injuries to his neck and back. He sued Rodriguez for negligence.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he attempted the left turn after he pulled out from a stop sign when defendant, all of a sudden and without notice, pulled out from his side of the intersection, causing the collision. Plaintiff further contended that defendant failed to yield the right of way.
DEFENDANT'S CONTENTIONS:
Defendant contended that he was not negligent and that plaintiff was the sole proximate cause of the accident. Defendant contended that he reached the intersection first, and that plaintiff was the one who failed to yield the right of way.
Damages
Guantes sought recovery for past medical costs and pain and suffering.
Injuries
Guantes treated with a chiropractor and was diagnosed with soft-tissue injuries to his neck and back.
Result
The matter proceeded to arbitration. The arbitrator ruled in favor of Guantes and his mother, and awarded a total of $10,982 in damages.
