Facts

On June 21, 2009, Michael Donovan fell while walking on a sidewalk in the City of Glendale, and suffered injuries to his eye and facial bones. He was leaving a party hosted by Mary McVay when the fall occurred. Donovan sued Glendale and McVay. McVay was dismissed from the suit.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he tripped and fell over the sidewalk due to a crack and a raise in the sidewalk, caused by a tree.

DEFENDANT'S CONTENTIONS:
Defendant contended that plaintiff fell due to his inattentiveness. The City also claimed that it had no notice of any issue with the sidewalk prior to the incident.

Injuries

Plaintiff suffered injuries to his face, arms, and eye, and required surgery on his eye. He also claimed vision impairment.

Result

The parties settled for $125,000.
