Valentine Buttarazzi was riding his bicycle on the right shoulder of the street when he was struck by a vehicle driven by Rodney Medinilla. Medinilla admitted he had not seen Buttarazzi but heard the sound of impact. After the collision, Medinilla continued down the street before pulling over because he believed it not safe to stop. Several eyewitnesses saw this and two women ran up to him to tell him he had struck a person.
Buttarazzi had no recollection of the incident.

Injuries
Plaintiff sustained a lacerated spleen, concussion, and abrasions. He was hospitalized for four days. Hospital care was limited to observation relative to his injuries. In the ER, plaintiff was found to have previously undiagnosed Stage IV pancreatic cancer.

The jury awarded the plaintiff $7,748 in past medical costs and $350 in property damage.
