Troy Torres sued Maria Manzo, Maria Olaez, Dawn Olaez and Casey Freitas, in connection with a motor vehicle accident involving multiple vehicles.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he was rear-ended by Manzo as he was slowing down to partially enter into a center divide to make a turn. Freitas was also involved in the accident. Plaintiff sustained injuries as a result of the collision and sued Manzo and the owners of her vehicle, Maria and Dawn Olaez, and Freitas. Plaintiff alleged that Manzo and Freitas were liable for the accident because they were negligent and that Maria and Dawn were liable for Manzo's actions. Plaintiff alleged that Manzo caused the accident by changing lanes unsafely.
DEFENDANTS' CONTENTIONS:
Defendant Manzo alleged that she tried to slow down after noticing plaintiff's truck slow down. However, her vehicle spun uncontrollably, causing her to strike the center divider.
Settlement Discussions
Torres made a CCP 998 demand for $25,000.
Injuries
Torres claimed he sustained injuries to his knee, chest, ribs, and stomach area. He also received chiropractic treatment.
Result
Freitaz, Maria and Dawn were ultimately let out of the case. Then, Manzo agreed to settle for $25,000.
