Kathleen McNally filed a lawsuit against Reda Elgawly in relation to a rear-end motor vehicle accident.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on March 4, 2013, she was driving her vehicle and stopped at a red light at an intersection. She claimed that defendant's vehicle then crashed into the rear of her vehicle, causing damage and injuries. She also alleged defendant immediately apologized for the accident and admitted that he dropped his eyeglasses before the crash and had not been paying attention to traffic conditions in front of him.
DEFENDANT'S CONTENTIONS:
Defendant denied plaintiff was damaged to the extent alleged.
Damages
Plaintiff requested past medical expenses of $14,786.31, and past lost earnings of $15,827.23.
Injuries
McNally claimed she suffered back, neck, elbow, wrist injuries, and a herniated C5-6 disc, and underwent epidural injections, steroid injections and physical therapy.
Result
The parties reached a settlement of $80,000 at a mandatory settlement conference.
