PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that Star Semiconductor developed a SPROC chip and a development system called SPROClab. In 1991, Star filed U.S. Patent No. 5,287,511, entitled "Architectures and Methods for Dividing Processing Tasks into Tasks for Programming Real Time Signal Processor and Tasks for a Decision Making Microprocessor Interfacing Therewith." Plaintiff alleged that it acquired Star's software development tools and intellectual property after Star became insolvent. Plaintiff alleged that in February 1994, the same day that the '511 patent was issued, it filed a continuation application. The application was issued as U.S. Patent No. 5,524,244, entitled "System for Dividing Processing Tasks into Signal Processor and Decision-Making Microprocessor Interfacing Therewith." Plaintiff alleged that defendant infringed on the '244 patent by using its patented programming systems in its operating systems and other software used in its products.
DEFENDANT'S CONTENTIONS:
Defendant moved for summary judgment of invalidity under the doctrine of "obviousness-type double patenting."
Result
The court granted Apple's motion for summary judgment of invalidity.
