Facts

The United States filed a lawsuit against The Zaken Corp. and Tiran Zaken for civil penalties, permanent injunctive and other equitable relief.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiff alleged that defendants sold the work-at-home business QuickSell to consumers by making false and misleading statements. Plaintiffs contended that through mailers, defendants represented to consumers that they would earn $4,000 or more in the first 30 days. Plaintiff further alleged that despite defendants' representations, consumers did not earn significant income from the QuickSell business opportunity. Plaintiff also argued that defendants failed to provide certain required written disclosures to consumers about the defendant to allow consumers to verify defendants' claims.

DEFENDANTS' CONTENTIONS:
Defendants denied the allegations of the plaintiff's claims.

Result

After granting plaintiff's motion for summary judgment, the court entered a final order for permanent injunction and other equitable relief. Defendants were enjoined from marketing or selling any "Work-at-Home Opportunity" or "Business Opportunity." The defendants were also enjoined from misrepresenting any material facts in connection with selling any good or service. Defendants were also ordered to dispose of, and not use, customer information that it obtained through it products or opportunities related to the allegations of this case. The court also ordered judgment to be entered against defendants in the amount of $25,406,781 as equitable monetary relief for consumer injury.
