Facts
On April 7, 2014, deputies with the Los Angeles County Sheriff's Department responded to an emergency call at an apartment building located in West Hollywood. While there, deputies shot plaintiff in the leg.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that Sheriff's Deputies mistook him for the suspect in a domestic dispute at his apartment building and opened fire on him, without provocation. Plaintiff was unarmed. Plaintiff was bleeding profusely because he had just been attacked by the suspect.
Plaintiff filed a civil rights complaint, asserting causes of action for battery, negligence, violation of California Civil Code Section 52.1, assault, violations of civil rights (42 U.S.C. Section 1983) individual liability under the Fourth Amendment, violations of civil rights (42 U.S.C. Section 1983) individual liability under the Fourteenth Amendment, and entity liability under the Fourth Amendment (42 U.S.C. Section 1983).
DEFENDANTS' CONTENTIONS:
Defendants denied plaintiff's allegations and asserted various affirmative defenses.
Result
Plaintiff settled with the Sheriff's Department for $2.5 million.
