PLAINTIFF'S CONTENTIONS:
Defendants allegedly raised plaintiff's rent unlawfully and committed elder abuse. Plaintiff asserted causes of action for declaratory judgment, elder abuse, wrongful eviction, and seizure of property without just compensation under color of authority.
DEFENDANTS' CONTENTIONS:
Defendants filed an unlawful detainer action against plaintiff in connection with the premises he rented from defendant North Richmond Senior Housing. The trial court entered judgment against plaintiffs and this instant lawsuit was only one of the many several attempts to challenge that judgment. Defendant moved to dismiss the lawsuit because it is frivolous.
Result
The court agreed with defendants and dismissed the action.
